Terms and Conditions

Unless otherwise required by law, these general terms and conditions apply to Private Escapades, whose registered office is at Rue Rossini 3, 4100 Boncelles, BCE No., hereinafter referred to as "the provider".

 

By booking a service, the client acknowledges having read and accepted the application of these general terms and conditions.

1. Services Offered

Unless otherwise required by mandatory legal provisions, these general terms and conditions govern (hereinafter "the services"):

- Personalized support services for tourist getaways;

- Subscriptions that provide access to exclusive content ;

- The organization of guided tours, circuits and excursions;

- Personalized assistance and advice for stays;

- Any service mentioned in the service description at the time of booking;

- Any additional service ordered at the time of booking and/or during the performance of the main service.

 

The services are described on the website ( www.privateescapades.com) with all the necessary information (date, duration, price, location, special conditions).

2. Booking and Payment

Except in exceptional circumstances, reservations are made exclusively via the website.

 

Payment must be made online at the time of booking by credit card or any other payment method offered on the website.

 

The reservation is confirmed upon receipt of full payment and sending of the confirmation by email.

 

By confirming their reservation, the customer agrees to approve the service provided by the provider or to issue reservations in the event that the service(s) provided are not satisfactory.

Acceptance of the service will be tacit, and therefore the service(s) will be considered approved, if the client does not raise any objections within 7 calendar days of booking confirmation, or directly at the time of booking if the booking is made within 7 calendar days of the service date. The transfer of risk occurs upon unconditional acceptance by the client.

 

Submitting a claim does not in any way relieve the customer of their payment obligations.

 

In the event of non-compliance with the provisions set out in the paragraphs above of Article 3 "Booking and Payment", the service provider may, by right and without prior specific notification, take each and every one of the following measures:
- Require the client to pay for the services or any remaining part of the services;

- Keep the amount(s) paid as an administrative fee;
- To completely interrupt the provision of service(s).

3. Rates and Fees

All prices are shown in euros, including VAT.


The client will be liable for any other reasonable costs or expenses necessary for the performance of the service.

 

The service provider reserves the right to change prices at any time, but the price charged to the customer is the one indicated at the time of booking.

4. Cancellation and Refund

In accordance with the provisions of the Belgian Code of Economic Law, the purchase of services offered by Private Escapades is firm and final.

 

Unless otherwise required by law, no refund will be granted after order confirmation and payment, for any reason whatsoever, including in the event of:

- Change of mind of the customer;

- Personal inability to participate in the experiment;

- Total or partial non-use of reserved services.

 

The services offered by Private Escapades are personalized and/or organised on a specific date, excluded from the right of withdrawal in accordance with the Belgian Code of Economic Law.

 

By way of derogation from the above provisions, an exceptional decision to refund or postpone may be considered on a case-by-case basis, exclusively at the discretion of the management of Private Escapades, without this constituting an obligation or an acquired right for the client.

Any favorable decision taken on an exceptional basis cannot under any circumstances create a precedent.

 

All requests must be made in writing (email or letter).

Failure to respond or a refusal will not give rise to any recourse, compensation or indemnity.

In the event of force majeure or cancellation by Private Escapades, the client will be fully refunded or a new date will be offered.

5. Liabilities

The service provider undertakes to exercise due care in the performance of the services entrusted to it, within the limits of the resources provided. These services constitute an obligation of means on its part. The service provider cannot be held liable for the results obtained.

 

The client participates in the services under their own responsibility.


The service provider shall be released from all liability with regard to any acts, writings, declarations and actions whatsoever taken by the client, its employees or any other third parties/sensitive beings, on their own initiative and/or without the knowledge of the service provider, and which could have adverse repercussions on the normal continuation of the services entrusted to it.

 

Private Escapades declines all responsibility in the event of:

- Accident, illness or incident occurring before, during and after the service;

- Loss or theft of personal belongings;

- External events independent of the company (weather, transport, site closures, etc.).

 

The client agrees to comply with the safety rules and instructions given by the guide.

6. Intellectual Property

All content on the website www.privateescapades.com (including, but not limited to: texts, images, photographs, videos, graphics, logos, icons, sounds, downloadable documents, site structure and layout) is protected by intellectual property law, in accordance with Belgian legislation and applicable international conventions.

 

This content is the exclusive property of Private Escapades, unless explicitly stated otherwise.

 

Any reproduction, representation, modification, publication, adaptation, translation or exploitation, in whole or in part, of these contents, by any means whatsoever and on any medium whatsoever, is prohibited without the prior written authorization of the rights holder, in accordance with the Belgian Code of Economic Law and international treaties relating to the protection of copyright and related rights.

 

Any unauthorized use of the site's content may result in civil and/or criminal prosecution.

 

The trademarks, trade names, company names and logos possibly mentioned on this site are protected and remain the property of their respective owners.

The service provider may create elements covered by certain intellectual property rights, including plans, drawings, specifications, reports, advice, analyses, designs, methodologies, code, artwork or any other element necessary for the provision of services to the client.
Unless the parties agree otherwise in writing, all intellectual property rights arising from services performed for the benefit of the client shall be considered as remaining the property of the service provider.

7. Confidentiality

The data collected during the booking process is used exclusively for the management of services and customer contact, in accordance with the GDPR and Belgian data protection legislation.

 

Both during the performance of services and after their completion, for whatever reason, the service provider undertakes not to disclose any secrets, personal or confidential information relating to the client which it may have learned during or before the performance of services, subject to the prior written consent of the client.


The service provider will not be bound by this confidentiality obligation if it proves that the information disclosed by it is information known to the general public.


The provisions set out in the last 2 paragraphs above of article 7 “Confidentiality” also apply to the case of the client.

8. Visual Recordings, Videos and Image Rights

As part of the services provided, photographs, videos, audio recordings or testimonials may be taken.

 

Any dissemination or use of the image, voice or content which allows the customer to be identified is strictly subject to prior, free and optional consent.

 

Refusal to give this consent has no impact on the booking or the delivery of the service.

 

The client may withdraw their consent at any time by sending a written request to (infos@privateescapades.com).

 

Withdrawal of consent does not affect the legality of broadcasts that took place before the request.

9. Exclusivity

The services provided by the provider are provided on a non-exclusive basis and nothing in these terms and conditions may be interpreted as limiting the provider's ability to provide its services to a third party during the term of the service, subject to full compliance with its obligations as defined in these terms and conditions.

10. Severability of Clauses

If one or more clauses of these general terms and conditions should be declared null and void, the other clauses shall remain in effect.

 

The parties will make every effort to try, by mutual agreement, to replace the clauses that have become obsolete with valid clauses whose objective will come as close as possible to that of the clause to be replaced.

11. Entire Agreement

Unless otherwise agreed in writing by the parties, these general terms and conditions supersede and replace any prior agreement, written or oral, between the parties and constitute the entirety of their agreement.

12. Breach of the Terms and Conditions

The failure of either party to enforce one or more provisions of these general terms and conditions shall not be construed as a waiver of such provision.

13. Amendments and Addenda

Unless otherwise agreed in writing by the parties, any deviations from these conditions must be recorded in writing and notified by a person authorized to bind Private Escapades.

14. Governing Law and Jurisdiction

These general terms and conditions are governed by Belgian law.


In the event of a dispute, the parties agree to appoint an accredited mediator and to participate in two two-hour sessions in an attempt to find an amicable solution.


In the absence of an amicable agreement, disputes will fall under the exclusive jurisdiction of the courts of the judicial district of Liège.
