Disclaimer
By confirming my booking with Private Escapades and ticking the acceptance box, I declare the following:
1. Risk Recognition
I acknowledge that the activities offered by Private Escapades, including but not limited to getaways, hikes, sports activities and artistic activities (hereinafter "the Activity"), involve inherent risks, such as (non-exhaustive list):
- Risks related to the terrain, weather conditions or the natural or urban environment;
- Physical risks related to exertion, movement, use of equipment or the nature of the activity;
- Risks related to my own state of health;
- Risks of accidents or unforeseen events that cannot be completely eliminated.
I confirm that I am participating voluntarily, with full knowledge of these risks.
2. Health status and abilities
I certify that I am physically and mentally fit to participate in the Activity.
I agree to inform Private Escapades of any health problems that may affect my safety or that of the group.
I acknowledge that Private Escapades does not have the ability to verify my state of health.
3. Compliance with instructions
I commit to (non-exhaustive list):
- Follow all safety instructions and recommendations provided by the supervisors;
- Adopt a prudent, responsible and respectful attitude towards the natural or material environment;
- Use all equipment provided by Private Escapades correctly.
I understand that failure to comply with these rules may increase the risk of accidents and make me liable.
4. Limitation of Liability
I acknowledge that Private Escapades (non-exhaustive list):
- Cannot be held responsible for damages caused by my own behavior, negligence or failure to follow instructions;
- Cannot guarantee a total absence of risk during the Activity;
- Cannot be held responsible for incidents or damages resulting from circumstances beyond its control and reasonably uncontrollable.
I understand that, in accordance with Belgian law, Private Escapades cannot exclude its liability in the event of gross negligence, intentional misconduct, fraud or failure to comply with its legal safety obligations.
5. Acceptance of Risks and Partial Release
To the extent permitted by Belgian law, I agree to assume the normal, foreseeable and inherent risks of the Activity.
I hereby release Private Escapades from all liability concerning (non-exhaustive list):
- Material or minor damage not resulting from any fault on his part;
- Injuries or incidents arising from risks inherent in the activity, despite reasonable safety measures;
- Unforeseeable or unavoidable events that Private Escapades could not prevent, even with normal diligence.
6. Personal insurance
I acknowledge that it is my responsibility to take out personal insurance covering my bodily injury, property damage or other damages, unless Private Escapades explicitly states that insurance is included in the service.
7. Full acceptance
By confirming my reservation (non-exhaustive list):
- I attest that I have read, understood and accepted this Disclaimer;
- I acknowledge having received sufficient information regarding the Activity;
- I participate voluntarily and accept the inherent risks.
